Participants will explore how factors like asset classes, interest rates, loan volumes, and debt types influence the need for various licenses—ranging from debt collection licenses to consumer and installment lender licenses. In her current role she speaks with the collection industry’s leaders to navigate clients through new licensing based on agency activity, statutory compliance notifications regarding corporate changes and overall client expansion and development. Her passion to see her clients succeed calls for her to continuously study the latest state licensing requirements and regulations to ensure proper licensing. Anastasia Caton is a partner in the Washington, DC office of Hudson Cook. Anastasia’s practice includes assisting national and state banks, savings associations, mortgage bankers, finance companies, and licensed lenders in the development and maintenance of consumer mortgage, automobile finance, and other credit programs. Anastasia also advises clients on various aspects of compliance with state and federal servicing and debt collection laws and the federal Fair Credit Reporting Act. In addition, she assists clients in handling federal government agency (including CFPB, FTC, and DOJ) and state attorneys general investigations. On behalf of clients, she drafts amicus briefs for filing in consumer credit cases before federal appellate courts, including the U.S. Supreme Court. Anastasia is active in the American Bar Association’s Consumer Financial Services Committee and currently serves as the Chair of the Young Lawyers Subcommittee. She has previously served as the Young Lawyer Liaison to the Debt Collection Practices and Bankruptcy Subcommittee and as the Young Lawyer Liaison to the National Institute on Consumer Financial Services Basics. She is also a member of the Receivables Management Association (formerly known as DBA International). Before joining Hudson Cook, Anastasia was a compliance attorney in the Regulatory Services Group at U.S. Bancorp in Washington, DC, and was a summer associate at a creditors’ rights and commercial litigation law firm in Raleigh, North Carolina. During law school, she worked in Tulane’s Domestic Violence Clinic, assisting victims of domestic violence in obtaining various legal protections. Anastasia graduated with a degree in Public Policy Studies from Duke University and earned her J.D. from Tulane University Law School, where she was awarded magna cum laude graduation honors. This course provides a general overview of applicable state and federal laws and regulations that impact debt buying companies, collection agencies, law firms, and creditors that purchase, sell, or collect purchased receivables. In addition, the course will highlight industry best practices contained in the Receivables Management Certification Program and discuss how those standards, in many instances, go beyond what is required by law. The Introductory Survey Course on Debt Buying is required for individuals seeking to become a Certified Receivables Compliance Professional (CRCP) through RMAI. Don Maurice is a partner at Maurice Wutscher LLP representing the financial services industry in compliance matters, bench trials, jury trials and appeals of individual and class actions. He is admitted to the Bars of Massachusetts, New York, New Jersey, and the District of Columbia and has practiced law since 1988. Don has been inducted into the American College of Consumer Financial Services Lawyers. Don serves as outside counsel to RMAI. He is a fellow at the American Bar Foundation and chairs the Consumer Affairs Committee of the New York City Bar Association. He formerly chaired the Debt Collection Practices and Bankruptcy Subcommittee of the American Bar Association. He is certified as a Leadership Professional in Ethics and Compliance by the Ethics Compliance Initiative. He is editor of the Consumer Financial Services Blog (cfsblog.com). He is a frequent speaker and author on ethics, financial services, and privacy law. His many articles on consumer financial services law have been published in law reviews and trade publications. Mark has been involved in the stratification of over 800 individual transactions, including the analysis behind the potential liquidation for over $20 Billion in purchased accounts. Mark is a frequent speaker on topics ranging from Data Security, Operational Best Practices, Historical Industry Analysis, Encryption Methodology, Risk Mitigation and Relationship Building. He was appointed to serve on the task force committee that implemented certification within RMAI, a cornerstone of what inevitably became RMAI’s federally recognized compliance program. He was also a founding board member of the Certification Committee and continues to teach the introductory course for Certification. An RMAI Certified Receivables Compliance Professional, Mark was elected to the RMAI Board of Directors in 2014, and after serving two terms as President.
