On August 12, 2024, the New York City Department of Consumer and Worker Protection (DCWP) published its long-awaited amendments to the City’s Debt Collection Rule and an FAQ. DCWP has been working on revisions to this rule since November 2022. It was the subject of two public comment periods which RMAI and an industry coalition submitted detailed responses on December 19, 2022 and November 29, 2023. Unfortunately, the concerns that were raised largely fell on deaf ears.

These rules are significant, complex, and in places arguably contradict existing state and federal consumer protections laws (please see RMAI’s August 16, 2024 Member Alert). This webinar brings together a panel of experts that will discuss these complicated amendments including the monthly log requirements, validation requirements, communication restrictions, expanded itemization requirements, time barred debt requirements, foreign language requirements, and medical debt limitations among other sections.  This session is designed to discuss the specific requirements, not the additional actions of RMAI in its advocacy on this matter.

Insights into the Consumer Default Judgments Act

This past July the Uniform Law Commission adopted the Consumer Debt Default Judgments Act.

The Act would materially modify existing procedures for obtaining default judgments on many types of consumer debt, including new notice requirements and the inclusion of certain documents and data in judgment applications. On February 13, 2024, a bill was introduced in Colorado that would adopt the Act, and it is anticipated several states will follow.

Our panel includes Raymond Pepe, Esq, who chaired the committee that drafted the Act. The panel also includes Franci Wayland of PRA and Don Maurice, RMAI’s outside counsel. They will discuss RMAI’s role in the drafting of the Act and, in particular, how the Act aligns with RMAI Receivables Management Certification Program standards.

New York City’s Proposed Amendments to its Debt Collection Law Dramatically Impacts Collection Systems, Processes, and Ability to Communicate – What You Need to Know to Comment

The New York City Department of Consumer and Worker Protection (NYC DCWP) just released an updated proposed amendment to its rules relating to debt collection. This updated amendment changes significantly more than the first proposed amendment released by NYC DCWP last year.  The proposed changes seek to update the NYC law to align with the FDCPA; however, the effect is significantly more broad.  The law would require new collection management systems and processes and will make it very difficult to reach out to NYC consumers.  The comment period ends November 29, 2023 – so we are asking anyone who collects in NY to join us this Thanksgiving week for a FREE webinar as our panelists break down the proposal, discuss the potential impacts to your business and NYC consumers, and prepare attendees to submit meaning full comments.
